1. Acceptance of Terms

By accessing or using etocit.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

These Terms govern your use of the Site only. Actual IT services provided by Etoc IT, LLC (“Etoc IT,” “we,” “us,” or “our”) are subject to a separate Master Services Agreement executed with each client.

2. Description of the Site

The Site provides informational content about Etoc IT, including our services, pricing, service area, blog posts, and contact methods. The Site also allows visitors to submit inquiries via a contact form and schedule consultations via our third-party booking tool.

3. Intellectual Property Rights

All content on the Site — including text, images, logos, graphics, code, and design — is the property of Etoc IT, LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, or print pages of the Site for your personal or internal business use. You may not:

• Reproduce, distribute, modify, or publicly display Site content for commercial purposes without written permission
• Copy or use the Etoc IT name, logo, or trademarks without written permission

Etoc IT does not warrant that: the Site will be uninterrupted, error-free, or secure; defects in the Site will be corrected; the Site or its servers are free of viruses or other harmful components; or that information on the Site is complete, accurate, or current at all times.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ETOC IT, LLC AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, LOST PROFITS, BUSINESS INTERRUPTION, OR OTHER COMMERCIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ETOC IT’S TOTAL CUMULATIVE LIABILITY UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED FIFTY US DOLLARS ($50.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless Etoc IT, LLC, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your use of the Site, or your violation of any rights of a third party.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States of America, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Nelson County, Kentucky, and you consent to the personal jurisdiction of such courts.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

11. Changes to These Terms

We may update these Terms at any time by posting the updated version on this page with a new “Effective Date.” Continued use of the Site after changes constitutes acceptance of the updated Terms. If you do not agree, please discontinue use of the Site.
